Terms of Service

1. Agreement to These Terms

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“you” or “Customer”) and SC Analytics Zones LLC (“we,” “us,” or “Company”) governing your access to and use of the SC Analytics Zones platform, available at scanalyticszones.app (the “Service”). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not access or use the Service.

2. License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service solely for your internal business purposes during your subscription period. No other rights are granted. You may not sublicense, sell, resell, or otherwise make the Service available to any third party.

3. Acceptable Use

You agree not to, and will not permit others to:

  • Use the Service for any unlawful purpose or in violation of any regulations;
  • Reverse engineer, decompile, or disassemble any part of the Service;
  • Upload or transmit viruses, malware, or other malicious code;
  • Attempt to gain unauthorized access to any portion of the Service or its related systems;
  • Use the Service to infringe the intellectual property or privacy rights of any third party;
  • Use the Service to transmit unsolicited communications or collect data about others without consent;
  • Interfere with or disrupt the integrity or performance of the Service.

4. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately at j.mayer@scanalyticszones.com of any unauthorized use of your account or any other breach of security. You agree to provide accurate, current, and complete information when creating your account and to keep that information updated.

5. Intellectual Property

The Service, including all software, algorithms, user interfaces, documentation, and content provided by us, is owned by SC Analytics Zones LLC and protected by applicable intellectual property laws. You retain all ownership rights in the data you upload to the Service (“Customer Data”). By uploading Customer Data, you grant us a limited license to process that data solely to provide and improve the Service.

6. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SC ANALYTICS ZONES LLC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS SHALL NOT EXCEED THE AMOUNTS PAID BY YOU TO US DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

8. Termination

Either party may terminate these Terms upon written notice. We may suspend or terminate your access immediately and without notice if we reasonably believe you have violated these Terms or if continued access would expose us or others to legal or security risk. Upon termination, your right to access and use the Service ceases immediately. Provisions that by their nature should survive termination will survive.

9. Governing Law

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which SC Analytics Zones LLC is incorporated, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved exclusively in the courts located in that jurisdiction.

10. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the “Last updated” date at the top of this page and, where appropriate, by email. Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms.
